Terms of Service
Effective: June 29, 2026 · Last updated: September 9, 2026
These Terms of Service (“Terms”) govern your use of the PROppeal app and website (the “Service”). The Service is operated by BrightBench LLC, a Nebraska limited liability company (“BrightBench,” “we,” “us”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
Important. PROppeal is a self-service tool. It is not tax, legal, or appraisal advice; we are not your agent or representative and don’t file on your behalf; and no particular savings or outcome is guaranteed. Always verify figures with your county before filing.
An appeal can also increase your assessment. In many states — including states where the Service is available — the board reviewing your appeal has authority to raise your assessed value, not only lower it. In some states an escalation is heard fresh, where a higher value can be argued for. We identify what your state allows and ask you to confirm you understand it before we generate anything, but the decision to file, and the risk of filing, are yours. See Section 5.
1. What PROppeal does
PROppeal helps you assemble a comparable-sales-backed property tax appeal letter and evidence summary that you review, sign, and file yourself with your taxing authority. We provide the tool and the supporting data; the decision to file, and the filing itself, are yours.
2. Not professional advice
PROppeal is not a law firm, tax advisor, or licensed appraiser, and using it does not create any professional or fiduciary relationship. The comparable sales we surface come from third-party data and are not a certified appraisal. Property-tax rules, deadlines, and outcomes vary by jurisdiction. You are responsible for confirming what applies to you.
3. Eligibility and availability
You must be at least 18 years old and able to form a binding contract. The Service is offered for U.S. residential property.
Availability is limited and varies. We open the Service state by state, and we support only certain property types. The app shows which states are open and will tell you before you spend a credit if your property is somewhere, or something, we can’t yet handle. Nothing in these Terms promises the Service is available for any particular property.
4. Your responsibilities
- Provide accurate information about your property.
- Verify all data and figures with your county before filing — including comparable sales, assessed values, and deadlines.
- You are solely responsible for filing your appeal, meeting all deadlines, and the content you submit. PROppeal does not file for you and does not guarantee any deadline.
5. If you appeal, your assessment can go up
This is the most important risk of using the Service, and it runs in the opposite direction from everything else on this page.
In many states the board that hears your appeal has authority to raise your assessed value, not only lower it or leave it alone, and states where the Service is available are among them. In some, appealing to a higher body means your value is heard fresh, and the assessor or a taxing body may argue for a higher number there. Increases on ordinary homes are uncommon, but they are real and they are permanent for that tax year. Whether either applies to you depends on your state, and can depend on your county and on the grounds you appeal on. The app identifies the rule for your property and asks you to confirm you understand it before we generate anything — that confirmation, not this section, is the disclosure of what applies to your property.
We identify what your state allows and ask you to confirm you understand it before we generate anything. That is the extent of what we can do: the decision to file is yours, and so is the outcome. If you are unsure whether filing is wise for your property, consult a qualified professional in your jurisdiction before you file.
6. Credits and purchases
- Some features require credits purchased through Apple. Purchases are subject to Apple’s terms, and refunds are handled by Apple under its policies, not by us.
- When a credit is used. A credit is applied to an appeal at the point you confirm the property address — before the comparable sales are gathered and before any letter exists. Once applied it is used, whether or not you go on to generate or file anything. We do not separately refund an applied credit; any refund request goes to Apple.
- One credit covers one property, including revisions. Editing or regenerating the same appeal does not consume another credit.
- Credits are consumable, tied to your account, and have no cash value. They do not currently expire; if we ever introduce an expiry we will give notice under Section 13.
- Deleting your account forfeits unused credits. Deleting your account removes your credit balance along with your data, and unused credits cannot be restored or transferred afterwards.
- Gifting credits, where offered, may be subject to limits we set. We may change features and pricing over time.
7. Data accuracy
Property and comparable-sales data is sourced from third parties and may be incomplete, out of date, or inaccurate. Estimates and valuations are not appraisals. We screen comps for quality, but you must verify everything before relying on it.
8. Acceptable use
Don’t misuse the Service: no reverse-engineering, scraping, reselling, interfering with its operation, infringing others’ rights, or submitting unlawful content.
9. Your content
You keep ownership of the information, photos, and signature you provide (“Your Content”). You grant us a limited license to use Your Content to operate and provide the Service — including sending it to the property-data and AI providers described in our Privacy Policy. You represent that you have the rights to submit Your Content.
How long the licence lasts. It lasts as long as we hold Your Content in order to provide the Service — which includes your saved appeals and, if you turn it on, cloud backup. Deleting your account removes that content and ends the licence, except for anything we are required to keep, such as purchase records. See Data retention and your choices in the Privacy Policy.
We do not publish Your Content. PROppeal is not a hosting, posting, or sharing service. Nothing you provide is visible to other users, and we do not display, distribute, or make Your Content public anywhere. It is used to prepare your own appeal documents and is sent only to the property-data and AI providers described in our Privacy Policy. Anything you file with your county, you file yourself.
If you nevertheless believe material on the Service infringes your copyright, email [email protected] identifying the work, what you say infringes it and where it appears, and how to reach you. We will look into it and remove anything that should not be there.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT ANY APPEAL WILL SUCCEED.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BRIGHTBENCH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST SAVINGS, INCREASED ASSESSMENT, OR MISSED DEADLINES. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.
12. Indemnification
You agree to indemnify and hold BrightBench harmless from claims arising out of your misuse of the Service or your violation of these Terms.
13. Changes & termination
We may modify the Service or these Terms. We’ll update the “Last updated” date, and material changes will be communicated where appropriate. Continued use after changes means you accept them. We may suspend or end access for violations of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Nebraska, where BrightBench LLC is organized, without regard to its conflict-of-laws rules.
Talk to us first. If something goes wrong, email [email protected] describing the problem and what you would like us to do. Most things are resolved this way. We ask that you give us 30 days to try before starting a formal proceeding, and we will do the same before bringing one against you.
Where claims are heard. If we cannot resolve it, you and BrightBench agree that any claim arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Nebraska, and each of us consents to personal jurisdiction there. Small-claims court is an exception — either of us may bring a qualifying claim in small-claims court where we live instead.
There is no arbitration clause here, and that is deliberate. These Terms do not require you to arbitrate, and they do not ask you to give up your right to take part in a class action. Nothing in these Terms limits any right you have under the consumer-protection laws of the state where you live.
15. Apple App Store
These Terms are between you and BrightBench only, and not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide any maintenance or support for the Service. If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation of any kind. BrightBench, not Apple, is responsible for addressing any claim relating to the Service, including product liability claims, any claim that the Service fails to conform to a legal requirement, and claims arising under consumer protection or similar legislation. BrightBench, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the Service infringes that party’s intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.
16. General
Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest of these Terms remain in force. Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and BrightBench about the Service. No waiver. Our failure to enforce a provision is not a waiver of it. Assignment. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale of assets. Survival. Sections 2, 5, 9, 10, 11, 12, 14, 15 and this Section 16 survive termination. Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control. Notices. We may give notice through the app, the Service, or the email associated with your account.
